Car dealers contest new consumer rights protections for vehicle purchasers

The Federal Trade Commission recently implemented new, comprehensive consumer protection regulations for auto dealers, aimed at banning bait-and-switch advertising, eliminating unnecessary add-on costs, and requiring accurate pricing disclosures. The rules will take effect on July 30, but they are already facing legal challenges from industry groups.

The National Automobile Dealers Association (NADA) and Texas Automobile Dealers Association filed a legal challenge in the Fifth Circuit Court of Appeals, arguing that the regulations are “arbitrary, capricious, and an abuse of discretion.” They claim that the rules will significantly disrupt the sales process for consumers and small businesses.

Meanwhile, the Alliance for Automotive Innovation, which represents major automakers like General Motors, Toyota Motor, and Volkswagen, has also expressed concerns about the new regulations. They fear that the rules could lead to excessive regulation and micromanagement of the sales experience, potentially hindering innovation in the industry.

On the other hand, a group of 17 Democratic lawmakers has urged the FTC to adopt strong regulatory protections for car buyers, emphasizing the widespread consequences of unfair and deceptive practices by motor vehicle dealers.

The regulations aim to save consumers more than $3.4 billion annually and streamline the car-buying process, while also mandating dealers to obtain consent for any added charges and preventing them from charging for unnecessary add-ons. Despite the debates and legal challenges, the industry remains focused on ensuring a fair and transparent car-buying experience for consumers.
